In the early months of 2020, the deadly Covid-19 disease spread rapidly around the world. In response, national and regional governments implemented a range of emergency lockdown measures, curtailing citizens’ movements and greatly limiting economic activity. More recently, as restrictions begin to be loosened or lifted entirely, the use of so-called contact tracing apps has figured prominently in many jurisdictions’ plans to reopen society. Critics have questioned the utility of such technologies on a number of fronts, both practical and ethical. (...) However, little has been said about the ways in which the normative design choices of app developers, and the products that result therefrom, might contribute to ethical reflection and wider political debate. Drawing from scholarship in critical design and human–computer interaction, this paper examines the development of a QR code-based tracking app called Zwaai (‘Wave’ in Dutch), where its designers explicitly positioned the app as an alternative to the predominant Bluetooth and GPS-based approaches. Through analyzing these designers’ choices, this paper argues that QR code infrastructures can work to surface a set ofethical–political seams, two of which are discussed here—responsibilizationandnetworked (im)permanence—that more ‘seamless’ protocols like Bluetooth actively aim to bypass, and which may go otherwise unnoticed by existing ethical frameworks. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

In order to improve our understanding of the components that reflect functionally important processes during reward anticipation and consumption, we used principle components analyses (PCA) to separate and quantify averaged ERP data obtained from each stage of a modified monetary incentive delay (MID) task. Although a small number of recent ERP studies have reported that reward and loss cues potentiate ERPs during anticipation, action preparation, and consummatory stages of reward processing, these findings are inconsistent due to temporal and spatial overlap (...) between the relevant electrophysiological components. Our results show three components following cue presentation are sensitive to incentive cues (N1, P3a, P3b). In contrast to previous research, reward‐related enhancement occurred only in the P3b, with earlier components more sensitive to break‐even and loss cues. During feedback anticipation, we observed a lateralized centroparietal negativity that was sensitive to response hand but not cue type. We also show that use of PCA on ERPs reflecting reward consumption successfully separates the reward positivity from the independently modulated feedback‐P3. Last, we observe for the first time a new reward consumption component: a late negativity distributed over the left frontal pole. This component appears to be sensitive to response hand, especially in the context of monetary gain. These results illustrate that the time course and sensitivities of electrophysiological activity that follows incentive cues do not follow a simple heuristic in which reward incentive cues produce enhanced activity at all stages and substages. Compared to approach motivation, avoidance motivation evokes vigilance, attention to detail, systematic information processing, and the recruitment of cognitive resources. From a conservation of energy perspective it follows that people would be reluctant to engage in the kind of effortful cognitive processing evoked by avoidance motivation, unless the benefits of expending this energy outweigh the costs. We put forward three empirically testable propositions concerning approach and avoidance motivation, investment of energy, and the consequences of such investments. Specifically, we propose that (...) compared to approach-motivated people, avoidance-motivated people (a) carefully select situations in which they exert such cognitive effort, (b) only perform well in the absence of distracters that occupy cognitive resources, and (c) become depleted after exerting such cognitive effort. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. Strangers to Nature brings together many of the leading scholars who are working to redefine and expand the discourse on animal ethics. This volume will engage both scholars and lay-people by revealing the breadth of theorizing about the human/non-human animal relationship that is currently taking place.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Jean-Michel Racault, Emeritus Professor of the University of La Réunion and general editor of the Œuvres complètes of Bernardin de Saint-Pierre in progress under the Classiques Garnier imprint, is an acknowledged expert in utopian studies, and works edited and presented by him in this field will be justly welcomed with keen interest and appreciation. It inspires confidence [End Page 168] that this edition should be the fruit of many years’ study and find its origins in his two theses of 1981 and 1987 and articles of 1991, 2003, and 2010 (21 n. 21). The blurb announces this volume as bringing together “three major works of political thought of the end of the seventeenth century representative of ‘Louis XIV utopias,’” a label that could be supposed to imply an anti-absolutist outlook in the three writers. But Racault argues that the idea, as put forward by the late Myriam Yardeni in her 1980 study Utopie et révolte sous Louis XIV, that these classical utopias express revolt against the monarchy of Louis XIV should be treated in a nuanced way, even with serious reservations (7, 217–18).Racault writes with impressive depth and clarity and makes a superb guide, yet it by no means follows that these works are easy to interpret. Indeed, part of his achievement is to show they may not be so and to offer evidence to suggest that they may invite “multiple possible readings.” The blurb gives fair warning of irony, ambiguity, and contradictoriness, and states that the utopia of these experimental fictions can be inverted to become an “anti-utopia.” As Racault observes with admirable honesty in his preface, “Ambivalence, uncertainty, and a sense of complexity are in fact characteristics of these utopias, in which one sometimes has the impression that the author develops lines of thought that are ideologically incompatible and does not know himself on which side he stands” (19). Racault exemplifies this paradox by reference to Foigny’s hero, “a Pascalian libertin as well as a Christian deist” (19–20). One might be allowed to object that this is to offer the reader who seeks it no clear utopian vision, and that such ambiguity leads to confusion worse confounded; indeed, I am tempted to wonder if ambiguity here reveals subtlety of thought less than a mere lack of perspicuity. Racault makes the highly important point that a similar duality “penetrates the accounts of Veiras and Fontenelle and prevents one from seeing them as simple preludes to Enlightenment thought” (20). Two more vigorous quotations may suffice to convey the flavor of this argument of duality: “the deism of La Terre Australe connue can also be read as a critique of deism, the [...] democratic humanism of the Histoire des Ajaoïens includes a utilitarian system of colonial domination” (21). Again, “the ‘heliocratic’ Sevarambian system inspired by the empire of the Incas after Garcilaso de la Vega [?1501–36] is essentially a theocratic absolutism in the end not much different from the monarchy of Louis XIV. Ajao, on the other hand, has no monarchy, and no ministers” (460). As to this variety between the texts, another indication is that Foigny’s land is anarchical (but [End Page 169] well ordered!), whereas Veiras’s can be understood as embracing certain policies of Colbert (236 and n. 14, 292 and n. 46), to whose protégé Pierre-Paul Riquet, baron de Bonrepos (1609–80), Veiras’s account is dedicated (231–34, 306–7).This substantial but not overlong volume is tastefully adorned with attractive covers and five splendid and richly annotated plates of maps illustrating the subject of the “Imaginary Voyage” or “Extraordinary Voyage,” a term used in a... For both G. E. Moore and Bernard Lonergan, the question of the good provides a fundamental heuristic indicating its irreducible and thus transcending nature. In Lonergan’s later work, the focus is primarily on the good as manifest in intentional responses to values. But the fundamental metaphysics of the good is never absent from this perspective, and it re-appears explicitly in some later writing. Moore’s anti-reductionist metaethics played a central role in the debates to follow in analytical philosophy in the (...) decades after the appearance of Principia Ethica. In this article, I explore possible convergences between these two avenues of speculation, which in their way both witness to the abiding significance of the scholastic notion of the good as a transcendental. It is argued that the wider purview offered by Lonergan’s analysis of the good, sought in questions as implying metaphysical and theological dimensions, assists in rendering cogent the objectives to which Moore’s question of the good points. Britain's “restless republic” survived for only eleven turbulent years, from 1649 to 1660. Britain today is a somewhat restless monarchy, troubled from within by two turbulent and disgruntled royal princes, Andrew and Harry, and from without by considerable public unease. If the two princes had been firstborns rather than younger brothers, and in the direct line of succession, the long-term future of the monarchy would look very uncertain. Charles I, stubborn and inept, was a younger brother too. Had his (...) very popular older brother Henry, Prince of Wales, not died at the age of eighteen, from typhoid fever caught by swimming in the river Thames (very unwise then as now), the English Revolution might well never have happened. A generation later, Charles II came close to facing a second revolution, so we monitor the reign of Charles III with interest and some trepidation.Keay gives us the dramatic history of the republic through the eyes and lives of a dozen or so very diverse individuals and families. They include several major players, such as John Bradshaw, the judge who sentenced the king to death; Oliver Cromwell, the Lord Protector; and George Monck, architect of the Restoration. The cast of characters also includes a brilliant, time-serving journalist, a Norfolk country squire, a formidable French-born countess, an ambitious inventor, a lowborn visionary and prophetess, and Gerrard Winstanley, leader of the tiny Digger movement. Winstanley established a small and short-lived communist settlement in Surrey in 1649, and his name is still commemorated centuries later in an obelisk standing in Moscow's Red Square, credited as a forerunner of the Bolshevik Revolution. The settlement's site is now, paradoxically, home to a gated community of the megarich. Keay weaves these personal stories into a wider narrative of events across England, Scotland, and Ireland. Remarkably, she gives us a sympathetic and empathetic insight into each of her diverse subjects’ minds and lives. We enter their worlds and see events through their eyes, words, and actions. The composite world that emerges is splintered and full of contradictions, and Keay does not ignore the sometimes darker elements in her subjects’ visions and lives. I have been reading and writing on this period for over fifty years, and this book is probably the most engaging, page-turning account of it that I have encountered. Keay captures brilliantly its people and places, and her judgments are sharp and perceptive. There are lots of good pictures too. This is an ideal introduction for anyone coming new to the subject, or indeed new to history, and with plenty to delight hardened veterans too. Do read it. (shrink)

Indeed, the paper claims that such a situation affords the possibility of becoming even more attentive to the conditions of meaningfulness at a global scale. It evidences such a claim by first tracing some essential points of the meaning of meaning via the analysis (...) of intentionality in the work of Edmund Husserl and Bernard Lonergan; then, it reviews the classic treatment of the smile’s meaning by Frederick Buytendijk, along with Lonergan’s further clarification of how an pre-thematic or elemental relation between persons conditions the phenomena; it concludes by suggesting how various sorts of disruption might motivate the smile’s thematization, especially in phenomenology’s inquiry back to the elemental dimension of meaning. The widespread influence of skeptical and relativist philosophies has led to an abandonment of empiricist accounts of objectivity in historical investigation. Can one do justice to the historical conditionedness of the historian without totally denying objectivity in historical judgments? This article introduces Bernard Lonergan's answer to this question. Lonergan contends that one can avoid both the Scylla of naive empiricism, fostering the myth of some simple backward gaze at the facts of the past, and the Charybdis of total relativism. (...) He proposes a form of perspectivism which, he believes, does justice both to the belief of the majority of working historians that they are gradually increasing our knowledge of the past, and to the points brought out by writers on historiography, such as the "metahistorians," concerning the impossibility of ascending to some god's-eye view of the historical process.Lonergan's perspectivist position is built upon a prior philosophical account of cognition and epistemology, which I outline here. I will then move on to some immediate concerns of working historians, such as value judgments in history, the relationship of historical data to the facts the historian claims to know, and the criteria of selection used by the community of historians. In treating these issues I will highlight some of the areas of convergence and divergence between Lonergan's work and that of other philosophers and historians who have written on historiography. Elizabeth Anscombe (1919–2001) was a significant figure in twentieth-century philosophy. Her work is characterized by the attempt to retrieve and deploy some of the insights of Aristotle and Aquinas in the light of the philosophical perspectives of her mentor, Ludwig Wittgenstein. Bernard Lonergan was also a twentieth-century thinker concerned to retrieve and develop perspectives from the Aristotelian-Thomist tradition in the context of modern and post-modern thought. This article attempts to initiate a critical dialogue between the thought of these two (...) philosophers. Anscombe’s philosophical views on topics such as self-knowledge, conscious intention, and the foundations of ethics are discussed and critically evaluated. Bernard Mayo, who died in 2000, was Professor of Moral Philosophy at the University of St Andrews from 1967–1983. He chose his 19th century predecessor J F Ferrier as the subject of his inaugural lecture delivered on 26th November 1969. Copies of the lecture were printed and distributed, but it was never published. Mayo's choice of subject for his inaugural shows remarkable and at the time highly unusual insight into the value Ferrier's philosophical writings, and rising current interest in (...) Ferrier warrants its publication now, in a lightly edited version that has eliminated references to the specific occasion on which it was delivered. Mayo explores Ferrier's version of the contrast between the human and the natural as a means of illuminating the 20th century debate between realists and relativists in moral philosophy. (shrink)

We have two aims in this paper. The first is negative: to demonstrate the problems in Bernard Gert’s account of common morality, in particular as it applies to professional morality. The second is positive: to suggest a more satisfactory explanation of the moral basis of professional role morality, albeit one that is broadly consistent with Gert’s notion of common morality, but corrects and supplements Gert’s theory. The paper is in three sections. In the first, we sketch the main features (...) of Gert’s account of common morality in general. In the second, we outline Gert’s explanation of the source of professional moral rules and demonstrate its inadequacy. In the third section, we provide an account of our own collectivist needs-based view of the source of the role-moral obligations of many professional roles, including those of health care professionals. Many of us are inclined to accept something like the following principle: We can only be properly morally assessed for what is in our control. And yet our ordinary practices seem to frequently violate this principle. The resulting tension, and the attempt to resolve it, is the problem of moral luck. For example, we tend to punish and think worse of the negligent driver who kills a child than we do the equally negligent driver who was lucky there was no (...) child in his path. Thus, the lucky outcomes of our actions do seem to affect the extent to which we hold and are held responsible, but these are not things over which we exercise control. And, as Thomas Nagel famously illustrated in his response to Bernard Williams (the two of which papers form the founding documents of the moral luck debate), the influence of luck is not limited to outcomes. For the circumstances in which we find ourselves and, indeed, our very constitution are also shaped by luck. Since the publication of Williams's and Nagel's papers, the existence and breadth of moral luck has been hotly debated. This debate is not a mere intellectual trifle but, as the essays in this volume illustrate, a debate which lies at the heart of free will, responsibility, identity, causation, and self-creation. Alain Badiou is described as a post-continental philosopher to distinguish his work from that of thinkers such as Derrida and Foucault. Indeed he is critical of key strategies characteristic of genealogical and deconstructive critiques, since he wishes to reconnect with fundamental metaphysical and ethical preoccupations of the western philosophical tradition. In Badiou’s work metaphysical, ethical and socio-political concerns are interwoven. In this article Ioffer a critical evaluation of Badiou’s philosophy, moving from an examination of his writing on ethics to the (...) ontological positions which underlie his ethics and socio-political critique. In my critical evaluation I draw attention to the new work going on in metaphysics in analytical philosophy, but, more fundamentally, I draw upon Bernard Lonergan’s critical realist thought. This paper makes use of an example of Williams’s, an example involving so-called psychological deprogramming–reprogramming, in arguing that procedures such as Teletransportation would not provide what matters to us in our self-interested concern for the future. This is so because the beliefs and other psychological states of a resultant person would not be appropriately causally dependent on any beliefs or other psychological states of the original person.

The paper centres on a particular pattern of argument in Bernard Bosanquet aesthetic writings. This pattern is one which has roots in a more general Idealist response to Kant's formulation of the problem of aesthetic judgment. In other words, it has roots in thinkers such as Schiller, Schelling and Hegel. The core of the pattern of argument concentrates on the relation, in both artistic production and contemplation, between reason and sensuousness and form and content. The paper tries to show (...) how Bosanquet, in formulating his aesthetic theory, fashions his argument into what I call a 'social aesthetic'. He is helped in this process of formulating a 'social aesthetic' by subtly linking his Hegelian-based arguments with the ideas of both William Morris and John Ruskin. Throughout the paper the various arguments revolve therefore around the central relation of reason and sensuousness and form and content. (shrink)
